Both topics will be discussed during the HCAOA New York Chapter Virtual Update today at 10:00 a.m. First, non-compete agreements may soon be unlawful in the state.
Eighty-nine percent of providers have had to deny home care because of the workforce crisis. On average, small- and mid-sized providers refuse 510 care hours each month, according to a new study released last week by MissionCare Collective, the parent organization of myCNAjobs. The study also notes that a majority of home care agencies have seen problems surrounding recruitment and retention worsen in the past six months. Last week, IDPH released proposed rulemaking updates for the Home Health, Home Services, and Home Nursing Agency Code to include requirements for home health and home services agencies with more than one location. The proposed rules impact branch offices, drop-sites, parent agencies, service plans, and service contracts.
Effective July 1, 2023, the South Carolina Department of Health and Human Services (SCDHHS) is consolidating multiple personal care and private duty nursing services into single procedure codes for personal care, private duty nursing and enhanced nursing. These service consolidations are being made to reduce the administrative burden for providers and support improved access to care. These changes affect State Plan private duty nursing services and services provided through home and community-based service (HCBS) waiver programs.
The Department of Social Services, Community Care Licensing Division has issued PIN 23-13-ASC, which supersedes PIN 23-07-ASC, dated April 6, 2023, and provides information on the end of the vaccination and booster requirement for all workers in Adult and Senior Care (ASC) facilities and the end of the masking requirement in ASC facilities.
On June 5, the Connecticut legislature approved a bill to expand disclosure requirements for home care agencies, such as when a HCA changes service rates or ceases operations. H.B. 6767 concerning licensing and enforcement proposed by the Department of Consumer Protection also requires background checks of certain prospective agency owners.

Following recent changes to federal requirements regarding COVID-19 vaccines, New Jersey Gov. Phil Murphy last week signed Executive Order (EO) No. 332 to lift the COVID-19 vaccination requirements for health care settings in New Jersey.
On June 2, Colorado Gov. Jared Polis signed into law Senate Bill 23-058, the Job Application Fairness Act (JAFA), prohibiting employers from inquiring about a job applicant’s age during the hiring process. JAFA’s enactment adds to the requirements and proscriptions Colorado has implemented in the hiring process, including a “ban-the-box” restriction on inquiring about criminal histories and requiring the inclusion of salary and benefits information in job postings.
