Last week, President Biden announced vaccine mandates for workers in “most health care settings” that receive Medicare or Medicaid reimbursement. This includes hospitals, dialysis facilities, ambulatory surgical settings, and home health agencies. HCAOA continues to monitor this development and those of various states to determine the impact on home care agencies providing personal care. The mandates relevant to home-based care providers do not have specific deadlines yet and require further rulemaking by CMS and OSHA, which is developing a rule that will require all employers with 100 or more employees to ensure their workforce is fully vaccinated. Workers who remain unvaccinated must produce a negative test result on a weekly basis before coming to work.
