Yesterday, HCAOA met with the Office of Information and Regulatory Affairs within the White House’s Office of Management and Budget to discuss CMS’ proposed Medicaid Access Rule, also referred to as the 80/20 Rule. This rule, among many other things, would mandate that 80% of Medicaid reimbursement dollars pass through to caregiver wages, leaving only 20% of the reimbursement for all other costs incurred in providing services. The meeting was held in accordance with Executive Order 12866, a Clinton-era order that mandates that OMB meet with stakeholders as part of the rulemaking process.
In attendance at the meeting were Jason Lee, CEO of HCAOA, Eric Reinarman, HCAOA’s VP of Government Affairs, HCAOA Board members Veronica Charles and Matt Kroll, and Ford Allison from TEAM Services Group. During the meeting, HCAOA reiterated that while it supports many aspects of the proposed rule, the 80/20 provision is totally unworkable and would cause many Medicaid providers to cease providing services entirely.
