The New York Department of Health (DOH) has released guidance outlining the due dates for Licensed Home Care Services Agencies (LHCSAs), Medicaid Managed Care Organizations (MMCOs), Certified Home Health Agencies (CHHAs), and Fiscal Intermediaries (FIs) to submit compliance certifications and statements related to the Home Care Worker Wage Parity Law (WPL).
These requirements, enacted as part of New York State’s 2020-2021 budget bill, mandate annual certification of WPL compliance, disclosure of wage parity hours and expenses, and the retention of independent auditors for verification. Covered entities are required to file their 2023 Annual Certification of Compliance via the eMedNY Provider Portal by December 1, 2023. LHCSAs and Fis must also submit the Annual Compliance Statement of Wage Parity, and Hours and Expenses (Form LS300) to MMCOs and CHHAs they contracted with in 2022 by December 31, 2023.
