New Laws in Illinois Affecting Home Care Employers and Employees – Learn More at 2/7 Chapter Meeting

Beginning in 2023, some new laws are taking effect in Illinois. The Illinois Department of Labor shared the following media release about New Laws Taking Effect in 2023 Impacting Employers, Employees.

Beginning in 2024, Senate Bill 208, the Paid Leave for all Workers Act will go into effect.

Key components of Senate Bill 208 include:
  • Beginning on January 1, 2024, all employers will be required to provide their employees with a minimum of 40 hours (or five days) of paid leave per year to be used for any reason. Employers may choose to offer more paid leave time.
  • A worker would begin to earn paid leave on their first day of their employment at a rate of one hour of leave for every 40 hours worked.
  • Employees may use their paid leave starting on the 90th day of employment. An employer, however, may allow a worker to use it earlier.
  • Workplaces can still require their employees to provide notice before taking paid time off. If the use of leave is unforeseeable, an employee is directed to provide notice as soon as possible.
  • Unused paid leave will carry over annually, up to 40 hours. However, employers are not required to cash out the balance of an outgoing employee’s paid leave.
  • Employers that violate the act would be subject to penalties, including fines and compensatory damages for the affected employee.

These new Illinois laws, especially the Paid Leave for all Workers Act from 2024, are pretty cool! It's awesome that employees will get at least 40 hours of paid leave each year. The meeting on February 7th sounds like a good way to understand these changes better. Kudos to the author for sharing this important info!

Will there be anymore meetings to discuss this new law? Or are there any suggestions for other websites that help break down the understanding of how to make sure we're staying legal?

If a caregiver is not on a client, are they still eligible to use their PTO whilst waiting for another client?
