In Delaware, Governor Carney has issued an Executive Order that sets out guidance for long-term care facilities and general essential businesses.
Last week, Governor Newsom of Californiasigned into law a new framework for workers’ compensation claims. Under the new law, illness or death related to COVID-19 is presumed to have been related to the course or scope of employment. Employers can dispute that presumption with evidence related to their reductive measures, outside risks, and any other evidence that could be used to dispute a workers’ comp claim.
In Pennsylvania, a federal court found that several restrictions put in place by Governor Wolf are unconstitutional. The Governor will be appealing this ruling, which would rule out limits on public gatherings and shutdown orders to “non-life-sustaining” companies. Meanwhile, the city of Philadelphia has expanded its emergency leave requirements.
