Cal/OSHA issued much-awaited FAQs which provide clarity on whether employers must continue to exclude fully vaccinated employees from the workplace if they were exposed to a confirmed positive COVID-19 case (at work or otherwise). Prior to this guidance, fully vaccinated employees in California with exposure were still required to be excluded from the workplace under Cal/OSHA’s Emergency Temporary Standards (ETS), but not under CDC guidance. This conflict was challenging for many employers because it effectively resulted in the exclusion of workers whose risk of transmission was low according to CDC guidance in order to ensure compliance with the ETS. Such exclusion requirements had onerous implications with continuing supplemental paid leave obligations under SB 95, the FFCRA, and the ETS. read more

Over the past several weeks, HCAOA has worked with state chapters to drive recognition for the direct care workers who have kept the country's most vulnerable populations safe at home throughout the pandemic. Georgia, Michigan, California and Illinois all have passed resolutions to honor these important caregivers. HCAOA state chapters in Michigan and California both held successful virtual lobby days this week. Washington held virtual lobby days a few weeks ago, and the Connecticut Chapter has its virtual lobby days coming up in April.
The Home Care Association of America (HCAOA) California Chapter received confirmation that a temporary workaround to the new Guardian system has been approved. Guardian is a new electronic data system, designed to streamline the background check process for all licensed care, including the TrustLine Registry, Home Care Aide Registry and Community Care Licensing staff.
