Final Rule Issued to Clarify Independent Contractor Status Under Fair Labor Standards Act The U.S. Department of Labor announced a final rule clarifying the standard for employee versus independent contractor status under the Fair Labor Standards Act (FLSA), which will streamline and clarify the test to identify independent contractors to reduce worker misclassification, reduce litigation, increase efficiency, and increase job satisfaction and flexibility. CMS recently issued guidance to state health officials designed to drive the adoption of strategies that address the social determinants of health in Medicaid and the Children’s Health Insurance Program (CHIP) so states can further improve beneficiary health outcomes, reduce health disparities, and lower overall costs in Medicaid and CHIP.
State Medicaid, CHIP Programs Receive Guidance on Returning to Routine Operations Post-COVID1/13/2021 Last week, the Centers for Medicare & Medicaid Services (CMS) released guidance intended to help states restore regular Medicaid and Children’s Health Insurance Program (CHIP) operations after the COVID-19 public health emergency ends. During the pandemic, CMS approved more than 600 requests for temporary program flexibilities or waivers to help states respond effectively to COVID-19. When the pandemic ends, many of these flexibilities and waivers granted to states will also end. |
