HCAOA CEO Jason Lee recently sent a letter to President Trump in response to his administration’s executive order directing departments and agencies to initiate a regulatory freeze for certain rules that have not taken effect, pending review by the newly appointed agency head. In the letter, HCAOA requests that the 80/20 Provision within the Medicaid Access Rule be invalidated or, at the very least, subjected to a comprehensive review. This provision, which was finalized in April 2024, carries significant consequences for the home care industry and the vulnerable populations we serve.

I strongly believe that the 80/20 rule is an overreach by the government. The cost to manage and run a successful home care business requires more than 20% of the gross revenue. Managing the staff, matching personalities with caregivers and patients, and making sure their trainings and credentials are current, are a few of the many things that an agency must have processes in place to be successful. More importantly this oversite is necessary to help ensure the safety of this vulnerable population.
