HCAOA is Preparing Submissions to Federal Agency Requests for Information (RFIs)

As part of our ongoing commitment to advocating for home care providers nationwide, HCAOA is actively compiling member feedback and conducting research to support comprehensive responses to multiple new Requests for Information (RFIs) and regulatory review opportunities recently launched by federal agencies. 
Below is a summary of upcoming deadlines for submissions as well as an idea of what each federal agency is specifically looking for.  We urge members to review these opportunities and share any specific regulations or policies they believe should be included in our responses. HCAOA has identified the companionship exemption, the 80/20 provision of the Medicaid Access Rule, and the proliferation of labor standards workforce boards as among the shortlist of regulatory priorities we plan to emphasize with these agencies.
 
Further, HCAOA has collaborated extensively with the U.S. Small Business Administration (SBA) to ensure understanding of our key issues across federal agencies, and to ensure that the regulations that prevent our members from efficiently delivering high-quality are prioritized and addressed.  In addition to our own submissions, the SBA has agreed to submit recommendations on our behalf to reinforce the urgency of addressing these regulations.
 
We look forward to being a voice for home care providers across the country and will keep members up-to-date as these deadlines approach.
 
Office of Management and Budget (OMB)
Deadline: Monday, May 12

  • OMB seeks proposals to rescind or replace regulations that stifle American businesses and American ingenuity. OMB is seeking comment from the public on regulations that are unnecessary, unlawful, unduly burdensome, or unsound. Comments should address the background of the rule and the reasons for the proposed rescission, with particular attention to regulations that are inconsistent with statutory text or the Constitution, where costs exceed benefits, where the regulation is outdated or unnecessary, or where regulation is burdening American businesses in unforeseen ways.
 
Federal Trade Commission (FTC) Regulations Hindering Innovation & Competition

  • The FTC launched a request for information soliciting public comment regarding federal regulations that “reduce competition, entrepreneurship, and innovation” and adversely impact the U.S. economy.
 
Department of Justice (DOJ) RFI on Anti-Competitive Laws and Regulations
Deadline: May 27, 2025

  • The DOJ is soliciting input on anti-competitive federal and state regulations—especially those affecting housing, transportation, food and agriculture, healthcare, and energy. Emphasized in the RFI is the importance of identifying regulations that can increase compliance costs and that prevent businesses from competing on a level playing field, and/or which discourage and unintentionally prohibit small business from entering markets and lowering prices for American families.  
 
Department of Government Efficiency (DOGE) Deregulation Portal

  • DOGE has opened a “Deregulation” Portal seeking public input on recent federal rulemakings that may be outdated, burdensome, or counterproductive.
