State-Specific Salary Requirements for Exempt Employees May Differ from Federal Requirements8/21/2024 Recent increases in the minimum salary thresholds for exempt employees under the Fair Labor Standards Act (FLSA) require employers to reassess their employees' exemption statuses. Effective July 1, 2024, the Department of Labor raised the minimum salary for executive, administrative, and professional exemptions to $844 per week (approximately $43,888 per year), with another increase set for January 1, 2025, raising the threshold to $1,128 per week (approximately $58,656 per year), and automatic updates starting July 1, 2027. However, employers must also consider state-specific laws, which might set higher salary thresholds for exemption eligibility than the new federal standards.

The helpful™ card works like a prepaid debit card. Payers can load money onto the card for eligible products and services.
Today, U.S. District Judge Ada E. Brown set aside the FTC’s sweeping ban on non-compete agreements, concluding that the rule was “arbitrary and capricious” and that the FTC lacked the statutory authority to issue the rule in the first place. (read Judge Brown’s decision here)
Last week, HCAOA Florida members gathered for a Chapter Networking Lunch and Meeting to learn about AHCA's updates on Alzheimer's disease and related disorders (ADRD) training requirements for non-skilled home care agencies and Medicare certification affecting PDN agencies. Updates on the Medicaid 80/20 provision, DOL Overtime Rule, the FTC Ban on Noncompete Agreements, and Chevron deference were provided.
Last month, Pennsylvania Gov. Josh Shapiro signed the Fair Contracting for Health Care Practitioners Act (HB 1633), which bans certain noncompete covenants, including patient nonsolicitation provisions, between an employer and health care practitioner if the covenant is more than one year or the health care practitioner was “dismissed by the employer.” The effective date of the Act is January 1, 2025, according to HCAOA Associate Member Littler.

Earlier this year, the U.S. Department of Health and Human Services (HHS) issued a final rule establishing the first federal regulations for Adult Protective Services (APS). The regulations took effect on June 7. The entire rule is at https://acl.gov/apsrule.

HCAOA is seeking nominations for four (4) open Corporate seats on the 2025 Board of Directors. Interested candidates are asked to complete the candidate interest form and submit all necessary information and documents by Friday, September 6, 2024. While there are no open Independent seats in 2025, candidates from Independent member agencies interested in serving on the HCAOA Board should still submit the candidate form to be in the running for any potential mid-year openings on the Board.

GUIDE focuses on dementia care management and aims to improve the quality of life for people living with dementia, reduce strain on their unpaid caregivers, and enable people living with dementia to remain in their homes and communities. |
